Heard learned counsel for the applicant.

The applicant has preferred an application seeking pre-arrest bail in the Court of the learned Sessions Judge, Pune. The learned Judge, after hearing the learned counsel for the applicant and after going through the police papers, found it appropriate to issue notice to the non-applicant i.e. the state of Maharashtra vide order dated 6th September 2021. 1/3

Learned counsel for the applicant submits that the matter was adjourned by the Sessions Judge on three occasions i.e. on 14th September, 21st September and 5th October 2021 and the matter is now posted on 13th October 2021.

Learned A.P.P, on instructions of the concerned Officer, submits that the prosecution will proceed with their arguments on the next date i.e. on 13th October 2021.

In view of the aforesaid, the learned Judge to either decide the said application preferred by the applicant (Exhibit 4), on the next date i.e. 13th October 2021 or consider the prayer for interim protection to the applicant, on its own merits.

With the aforesaid direction, the application is disposed of. It is made clear that this application has not been heard on merits and as such, all contentions of all parties are kept open. Learned counsel for the applicant to produce a copy of this 2/3

order before the trial court on 12th October 2021 so as to enable the learned Judge to take up the application pending before him on the due date. The application is accordingly disposed of.
