The petitioner seeks leave to convert the proceeding from Civil Writ Petition to Criminal Writ Petition and get the matter transfer to concerned Criminal Department for further process. Leave granted as prayed.

Heard learned Counsel for the petitioner. Issue notice to Respondents subject to condition that the Petitioner shall deposit the part amount of Rs.1,50,000/- towards part payment of maintenance. The amount be deposited before the Additional Sessions Judge, Ichalkaranji, in Criminal Waghmare 1/2

Failure to which the present Petition stands dismiss automatically without further reference to this Court and in case Petitioner succeeded to deposit the amount within stipulated period, issue notice to Respondents, returnable on 19.09.2018.

On depositing sum of Rs.1,50,000/- within stipulated period, there shall be stay to the operation and execution of the impugned order passed by the Additional Sessions Judge, Ichalkaranji, dated 02.07.2018 in Criminal Appeal No.29 of 2017, till the next date.
