Heard Mr. Pradhan, learned counsel for the Applicant and Mr.Sawant learned counsel for the C.B.I. By the impugned order dated 13th August, 2015, the Special Court (C.B.I.) rejected the request of the Applicant to grant interim relief. The learned Trial Court in the said order dated 13th August, 2015 has observed that the learned counsel for the Applicant is not ready and willing to argue the matter and sought adjournment. The Trial Court therefore rejected the prayer to grant the interim protection to the Applicant and kept the matter for hearing on 25th August, 2015 at 2.45 p.m.

Heard Mr. Pradhan, learned counsel for the Applicant at length. Mr. Pradhan submitted with fairness at his command that on 13th August, 2015 he was required to attend the High Court as he was appointed as amicus curiae in a matter where a question of law was involved and had therefore sought adjournment. He submitted that he is ready and willing to argue the matter on 19th August, 2015 before the Special Court. Learned counsel for C.B.I. Mr. Sawant has no

PNP 2/2 ABA1196-17.8 objection for the same.

In view of the same the Trial Court is hereby directed to prepone the hearing of Anticipatory Bail Application No.1727 of 2015 to 19th August, 2015 and hear the said application on its own merits without being prejudiced by the order of this Court.

In the meantime, i.e. upto 19th August, 2015, in the event of arrest of the Applicant, the Applicant shall be released on PR bond of Rs.50,000/- with one or two sureties in the like amount. The present Application is disposed of in view of the aforesaid terms.
