Considering the statements in the Civil Application supported by Affidavit, the similarity of address of Respondent No.1 in present proceeding as well as proceeding before the Trial Court, the only mode available to serve the Respondent No.1 is by substituted service. This is so as though on similar address Respondent No.1 was served in the proceeding before Trial Court and he remained exparte, the same address is reported as incomplete address in present proceeding. Hence Civil Application is allowed in terms of prayer clause 'a'.
