APPELLATE SIDE CRIMINAL JURISDICTION CRIMINAL APPLICATION NO. 1183 OF 2019 In CRIMINAL APPEAL NO. 812 OF 2013 Union Of India ....Applicant V/S Barry David Hulse And Anr ....Respondents Natarajan Narayanswamy, for the Appellant Dilip Mishra for the Respondent.
A. S. Patil, APP for the Repsondent-State.
CORAM : DAMA SESHADRI NAIDU, J.
DATED : 19th July 2019 P.C.:
Initially, the applicant, the Union of India, has filed this application seeking extension of time. This Court had granted time through its order dated 5th July 2019 to deport the respondent no.
1. Now on instructions, Shri Natarajan Narayanswamy, the learned Special Public Prosecutor for the Union of India, informs the Court that the applicant does not require extension of time. In this context, he brings to my notice the arrangement the Department and the respondent no. 1 seem to have arrived at. 2.
In fact, Shri Deelip Mishra, the counsel for the Respondent No. 1, submits that the respondent no. 1 will give an undertaking that he will return to India whenever his presence is required in AKN 1/2
2/2 909.APPA.1183.2019 the further judicial proceedings the Union of India may take up in future. He has also undertaken to get the confirmation from British Counsel that he is a British National. For this the Union of India has agreed.
3.
Under these circumstances, I reckon that Criminal Application No. 1183 of 2019 does not require any specific order passed.
