Since it is informed that in the present writ petition, the petitioner has raised a challenge to the order dated 21/09/2021 passed by the learned 2nd Additional Judge, Small Causes Court, Pune below Exh.5, by which the interim relief was granted, but the protection was not granted in respect of restraining the respondents from disturbing the possession. It is informed that subsequently Exh.5 has been disposed of and even an appeal has been instituted. In the wake of this development, the challenge posed in the present writ petition does not survive and rightly, learned counsel for the petitioner, seeks withdrawal of the petition.

The petition is permitted to be withdrawn and stands disposed of as such.
