This Appeal is preferred against an order dated 26/8/2010 passed by City Civil Court whereby Notice of Motion No.1063 of 2010 in S. C. Suit No.1019 of 2010 as filed by the Appellant/Plaintiff was dismissed. 2.

The Appeal came to be admitted on 1/3/2011 with clear observation that pendency of this Appeal in this Court will not operate as stay of the proceedings of the Suit and the trial Court is free to proceed with the Suit.
