Heard the learned counsel for the applicant and the learned APP.

On 28.1.2013, this Court (Coram: Smt. Sadhana S. Jadhav,J.) admitted the appeal. On 17.12.2013, none appeared for the appellant. This Court (Smt. Sadhana S.Jadhav, J.) issued bailable warrant against the appellant, returnable on 4.2.2014. On 28.1.2013, in fact, this Court (Coram: Smt. Sadhana S. Jadhav, J.) had suspended the substantive sentence and had granted bail to the applicant. It is clear from the records that the applicant herein has not furnished bail till today nor furnished surety.

The report of the Sessions Court, Thane, shows that the bailable warrant was served on 31.7.2014. Till today, the applicant has not furnished surety. The applicant has not complied with the order dated 28.1.2013 passed in Criminal Application No.91 of 2013. It is clear that the applicant has not reported to the Court of Ad hoc Addl. Sessions Judge, Thane, once in six months on the date specified by the Sessions Court. In view of this, the application deserves to be dismissed. 4.

Issue non-bailable warrant against the applicant. Non-bailable warrant to be executed through Senior Inspector of Police, Narpoli Police Station within two weeks from today.

Application is dismissed.

Office to communicate this order to the concerned Police Station forthwith.
