1) Heard. This is an application under section 438 of the Code of Criminal Procedure, 1973. Applicant herein is apprehending his arrest in crime no. 513 of 2016 registered at Yerawada Police Station for offence punishable under sections 406 & 420 r/w Section 34 of the Indian Penal Code. 2) On 24/11/2016, applicant was granted interim relief. Father of the applicant had depositned an amount of Rs. 27 Lakhs in Shivajinagar Court, Pune on 26/09/2016. The learned APP vehemently submits upon instructions from the officer that applicant has abided by the conditions imposed upon him ism

2 26.1390.16 aba vide order dated 24/11/2016. Hence, the order granting interim relief deserves to be confirmed as custodial interrogation in the present case would not be imperative. However, it is made clear that the observations made herein above are restricted to an application under section 438 of the Code of Criminal Procedure, 1973 and shall not be considered for quashing of F.I.R., discharge application or at the time of trial.

O R D E R

(i) Application is allowed.

(ii) In the event of arrest, applicant be enlarged on bail on furnishing P.R. bond in the sum of Rs. 50,000/- with one or more sureties in the like amount. (iii) Applicant shall report to the concerned police station as and when called.

(iv) Application stands disposed of.
