Heard the learned counsel appointed to espouse the cause of the petitioner and the learned APP for State. On the ground of sickness of the petitioner's wife, on 20th December 2012, parole was granted to the petitioner for a period of 30 days. The said period of parole was extended for total 60 days. Thus, the petitioner has already availed of parole for 90 days. Period of 90 days expired on 21st March 2013. However, the petitioner returned late by 22 days. Prayer in this application is for grant of further extension of parole by 22 days.

In view of Rule 25 of the Prisons (Bombay Furlough and Parole) Rules 1959, total period of parole cannot exceed 90 days. Hence, the prayer made in this petition cannot be granted.

crwp3022 However, this order will not preclude the petitioner from making a fresh application for grant of parole.

Subject to what is observed above, writ petition is rejected.

A copy of this order shall be forwarded to the petitioner through the concerned Jail Superintendent.
