Heard learned Counsel for the applicant and the learned A.P.P. 2.

The applicant has been convicted by the learned Judicial Magistrate First Magistrate, Alibag, vide Judgment and Order dated 1st October, 2010, in R.C.C.No.368 of 2009, for the offences punishable under Section 420 and 506 of the Indian Penal Code and is sentenced to suffer S.I. for one year and to pay fine of Rs.5,000/- in default to suffer S.I. for one month, for the offence punishable under Section 420 of the Indian

2/3 Penal Code and to pay fine of Rs.3,000/- in default to suffer S.I. for one month for the offence punishable under Section 506 of the Indian Penal Code. The appeal preferred against the said Judgment and Order has also been dismissed by the learned Additional Sessions Judge - 2, Raigad - Alibag, vide Judgment and Order dated 6th August, 2016. 3.

Learned Counsel for the applicant states that the applicant was on bail, pending the trial and his appeal and that he has not misused or abused the liberty granted to him. The Revision has been admitted by a separate order passed today in the Revision Application and the same is not likely to come up for the hearing in the immediate near future. 4.

Accordingly, the application is allowed and the applicant's sentence is suspended, pending the hearing and final disposal of the aforesaid Revision Application, and the applicant is enlarged on bail on the following terms and conditions :

ORDER

(i) The Applicant be released on cash bail in the sum of Rs.20,000/- for a period of four weeks;

3/3 (ii) The Applicant shall thereafter furnish P.R. Bond in the sum of Rs.20,000/- with one or two local sureties in the like amount, within a period of four weeks of his release on cash bail. 5.

The Application is allowed in the aforesaid terms and is accordingly disposed of.
