Shri Patil, learned AGP, points out that there is a delay of 175 days in filing the first appeal challenging the judgment and award dated 31 January 2018 passed by learned Civil Judge, Senior Division, Alibag in Land Acquisition Reference No.203/2016.

It is submitted that the delay has been caused in this matter because of administrative procedure, which needs to be followed and compiled with before filing the appeal. It is further stated that the file moves through various departments for obtaining approval, to file appeal and due to this reason, it took time to file appeal. 4.

39. caf 3687-2019 application pointing out various dates and the stages through which the file had moved. It is submitted that because of these administrative reasons, the delay has been caused, and therefore, he prays for condonation of delay.

Shri Patil, learned Counsel appearing for the Applicants, submits that the delay is unintentional but bonafide and therefore, it is prayed that the delay may be condoned.

No reply is filed by the Respondents opposing the application or disputing the fact stated in the application. Accordingly, I am of the opinion that the Applicants have shown sufficient reason for condonation of delay and therefore, the delay caused in filing the appeal needs to be condoned.

Accordingly, I pass the following order :
ORDER
(i) The application for condonation of delay is allowed. The delay caused in filing the first appeal is condoned.
(ii) The office is requested to register the first appeal and place the same before the court for admission. (ANIL S. KILOR, J.) 2 / 2
