Breach alleged in this petition is of the judgment and order dated 1st April, 2014. Learned AGP has placed on record a copy of order dated 2nd August, 2014 passed by the Divisional Commissioner by which application made by the petitioner under sub-section (1) of section 48 of the Land Acquisition Act, 1894 has been rejected. Thus, compliance has been made by the Divisional Commissioner with the direction contained in order dated 1st April, 2014.
2] The remedy of the petitioner is to challenge the said order. Learned counsel for the petitioner stated that till today the said order has not been communicated to the petitioner. If that be so, while filing the proceedings 1/2
*2* 906.cp624.14.doc for challenging the said order, the petitioner can always explain the delay by pointing out that till today, even a copy of the order was not made available to the petitioner. Subject to what is observed above, the petition is disposed of.
