1] This is an application under 439 of Cr. P.C. for bail in CR No.I-75 of 2017 dated 17.4.2017 registered with Vishnu Nagar Police Station, Dombivli,District-Thane under Sections 417, 419, 420, 46, 467, 468, 471 read 34 of the Indian Penal Code.

2] Heard the learned counsel for the applicant and the learned APP for the State. Perused the chargesheet.

3] It is the prosecution case that, the applicant and her husband deceitfully induced the first informant to part with sum of Rs.40,90,000/- by giving assurance that they will manage relinquishment of tenancy rights of the suit property and will give it for development to the informant. It is alleged that, the applicant along with co-accused prepared bogus deed of compromise with 1/2

ba.1808-2017.doc tenant Smt. Ranjana Deshmukh and produced before the first informant. As the first informant despite making payment did not get the property for development from the applicant and her husband, the present crime is registered. 4] The relevant documents have already been seized by the police and chargesheet has already been submitted. The record indicates that, the coaccused namely Arun Salvi i.e. the husband of the applicant has been released on bail by the Trial Court. The applicant is in jail since 17.4.2017. The applicant is a woman. The learned APP on instructions submitted that the trial of the present case has already began. It is submitted that, there are no antecedents at the discredit of the applicant.

5] In view thereof, the applicant can be granted bail. Hence, the following Order:- (i) Applicant be released on bail CR No.I-75 of 2017 registered with Vishnu Nagar Police Station, Dombivli on her furnishing PR bond in the sum of Rs.25,000/- with one or two solvent local sureties in the like amount; ii] The applicant shall also attend all the dates before the Trial Court unless precluded for medical reasons.
