By a reasoned Order dated 2.8.2017 the applicant was granted interim relief.

The record indicates that as a matter of fact the applicant has deposited an amount of Rs.50,000/ in the registry of the Sessions Court in pursuance of the Order dated 27.7.2017 passed by the learned Additional Sessions Judge, Greater Mumbai. By the said order the applicant was directed to attend the Investigating Officer on stipulated dates.

The record further indicates that since 2.8.2017 the applicant is sincerely complying with the said condition of attendance however, till date the Investigating Officer has not bothered to confront the other witnesses to establish the identity of the applicant as the same person mentioned in the first information report. After perusing the record of investigation, this Court is of the view that the custodial interrogation of the applicant for further investigation is not necessary. The interim relief granted by an Order dated 2.8.2017 is hereby confirmed. However, the condition to attend the concerned police station is waived. 5.
