The impugned order is passed on an application under Order 39, Rule 1 of the Code of Civil Procedure, 1908. Therefore, the applicant has remedy under Order 43, Rule 1(r) of the Code of Civil Procedure, 1908.

The revision application is, therefore, not maintainable. However, the applicant will be at liberty to file appeal under Section 104 of the Code of Civil Procedure, 1908. 3.

The civil revision application is dismissed.
