These applications are filed for suspension of substantive sentence of Imprisonment and for grant of bail by original accused no.2 Pushpa and accused no.3 Princee Singh who are convicted for the offence punishable under section 498A r/w Section 34 of the IPC, and are sentenced to suffer RI for 1(one)
Tilak 2/2 (911)APPA-1003-1004-16 year and to pay fine of Rs.5,000/- each in default to suffer RI for 6(six) months.
The learned counsel for the applicant states that fine amount is already deposited, and that applicants were on bail, pending trial. It is, therefore, prayed that application be allowed. From the copy of order of learned Sessions Judge, it appears that sentence is already suspended by said Court vide its order dated 30th July 2016. In that view of the matter and as it is no case that applicants while on bail, had misused liberty granted to them who also appears to be acquitted of the offence punishable u/s.306 IPC and as fine amount is paid, applications are liable to be allowed, suspending substantive sentence of applicants and their release on bail, as per order below.
O R D E R
Applicant Pushpa Singh and applicant Princee Singh shall be released on bail on their furnishing P.R Bond in the sum of Rs.15,000/- each with one surety in like amount each. (P.N. DESHMUKH, J)
