1] The applicant is apprehending arrest in CR No. 316 of 2018 dated 8.5.2018 registered with Daund Police Station, under sections 353, 379, 323, 504, 506 read with 34 of Indian Penal Code and section 21 of Mine and Minerals (Development and Regulation) Act, 1952. 2] Heard the learned counsel for the applicant and the learned APP for State. Perused the record of investigation. 3] The allegation against the applicant is that, he helped his friend in threatening and assaulting Government servants who were performing their lawful duty and also helped his friend in causing disappearance of truck loaded with illegally excavated sand which was seized by Tahasildar/ 1/2

During the investigation, the identity of the applicant has been revealed as "friend" of the driver of the motorcycle bearing No.MH-12-CJ7416. The allegation against the applicant of threatening the public servants is undoubtedly serious in nature and requires thorough investigation by the police.

4] In view of the above and after taking into consideration the allegation against the applicant and the gravity of offence, this Court is of the view that the applicant does not deserve to be protected by pre-arrerst bail.

Application is accordingly rejected.
