Civil Application is for condonation of delay of one year and 51 days in filing the First Appeal challenging the judgment and Award dated 11/01/2018 passed by learned Civil Judge, Senior Division, Alibag in LAR No.248 of 2016. The delay is adequately explained in paragraphs 3 to 5 of the Civil Application.

The Respondents although served have not appeared and have not filed any reply to the Civil Application. In view of this the contentions raised in Civil Application have remained uncontroverted. Therefore, for the reasons set out in the Civil Application is allowed in terms of prayer clause (b).
