The learned counsel for the applicant fairly submits that in the present case, the Special Court has recorded the substantive evidence of about 24 witnesses. It would not be appropriate to consider the application under Section 439 of Cr.P.C. The application stands disposed of. 2.
The learned Special Court shall make every endeavour to expedite the trial, as far as possible, and shall not grant unwarranted adjournments to the prosecution and shall also ensure that the accused are produced before the Court on each and every date failing which the learned Special Judge shall take appropriate action.
