Learned advocate for the petitioners on instruction seeks permission to withdraw this petition with liberty to file a fresh petition. It is submitted that in this writ petition the petitioners have challenged the order passed by the Sessions Court directing the trial Court to pass the order under section 156(3) of Cr. P. C. It is submitted that during the pendency of this petition, in pursuance to the order passed by the Sessions Court, the FIR has been registered.

In these circumstances, the petitioners seek to withdraw this petition with liberty to file appropriate proceedings to challenge the FIR and another proceedings.
