2) For the reasons stated in the application, the order dismissing the Civil Application is recalled and Civil Application No.2151 of 2012 is restored to fle qua respondent no.2. Civil Application No. 2964 of 2015 is made absolute in terms of prayer clauses (a) and (b). 3) Issue notice to respondent no.2 in Civil Application No.2151/2012 returnable after two 2 weeks i.e. on 28th February, 2022.
