1) In view of the earlier observations of this Court dated 20th July,2015 the learned counsel for the applicant/original de facto complainant prayed that the complainant may be allowed to withdraw the present proceeding and to go before the Sessions Court, Mumbai with an appropriate appeal under proviso to Section 372 of Cr.P.C. Hence, present proceeding is allowed to be withdrawn with liberty as prayed. The learned Sessions Court shall deal with the said appeal, if filed, in accordance with law and shall consider the aspect of condonation of delay as the applicant/appellant had filed the present application before this Court under erroneous belief.
