The learned counsel for the Petitioner submits that the Petitioner may be permitted to withdraw the Writ Petition with liberty to file appropriate proceedings under Code of Civil Procedure, 1908 to challenge the order dated 14.02.2014 passed by the 3rd Jt. Civil Judge, Junior Division Kolhapur in Misc. Application No.439/2012 for restoration of the Special Civil Suit No. 424/2009 which stood dismissed for non prosecution on 16.04.2012. To that effect, he has given in writing. Same is taken on record and marked "X" for identification.
