The learned APP, upon instructions, submits that the trial in MCOC Special Case No.10 of 2012 has commenced. The prosecution has examined two witnesses. The second witness is being cross-examined. In view of this, it would not be appropriate to consider an application under section 439 of Cr.P.C. The case is of the year 2012. Hence, the learned Special Court is requested not to give unwarranted adjournment to the prosecution and expedite the trial as far as possible. Application stands disposed of.
