Heard learned Counsel for the parties.

This application is for deleting the name of Respondent no.4 Smt. Haribai Gopala Pawar from cause title of Appeal memo.

Considering the submissions made by learned counsel for the applicant and averments made in civil application, I am satisfied that applicant has made out the case for allowing the civil application at their cost and consequences.

Hence, following order is passed:

i) Civil Application is allowed in terms of prayer clauses (a) to (d), which reads thus:

"a) This Hon'ble Court be pleased to delete the name of the deceased Respondent No.4 from the array of Respondents.

b) Delay of 10 years 69 days to file the present Civil Application be condoned.

c) Abatement against Respondent no.4 be set aside.

d) Permit the carry out the necessary amendment in the present Second Appeal."

ii) Civil Application stands disposed of accordingly.
