Rule. Rule is made returnable forthwith with the consent of the parties.

The learned counsel for the Petitioner submits that the office order dated 26th March, 2018 would be treated as a show cause notice to be served upon the Respondents. Respondent No.1 has accepted the notice. Respondent No.1 undertakes to file the reply by 24th November, 2018 to the Registrar. The Appropriate Authority shall consider the reply of Respondent No.1 and decide the matter in accordance with law within four weeks from the date

27- WP 9191 of 2018 of filing of the reply.

Respondent No.1 shall join the services as Associate Professor on 1st November, 2018. The issue of back-wages as directed by the College Tribunal will be decided subject to the decision of the Authority after considering the reply filed by Respondent No.1 4.

In the eventuality, an adverse order is passed, the same shall be stayed for a period of three weeks from date of communication.

With these directions, the petition stand disposed of. In view of the fact that the office order has been treated as a show cause notice, the order of the College Tribunal is set aside. All contentions of all the parties are kept open. [SMT.SADHANA S. JADHAV, J.]
