By the above Miscellaneous Civil Application filed under Section 24 of the Code of Civil Procedure, 1908, the Applicant-wife seeks transfer of Hindu Marriage Petition No.417 of 2016 filed by the Respondent-husband seeking dissolution of marriage between the Applicant and the Respondent pending before the Court of Civil Judge, Senior Division at Thane to the Family Court at Kolhapur. 2.
The Applicant-wife has done her Masters in the Science stream. The Respondent-husband has also cleared standard 12 th ( Science ). The distance between Thane to Kolhapur is approximately 900 kms. (to and fro). If either of the party is required to travel such a long distance, the same will cause grave inconvenience and hardship to them. Since both the parties are educated, the following order is passed by consent :
kpd 2 / 2 915-MCA-235-2016.sxw (i) The Civil Judge, Senior Division at Thane shall proceed with Hindu Marriage Petition No.417 of 2016 through video-conferencing. (ii) The District Court at Kolhapur shall render all assistance to the Applicant and/or her Advocate to use the video-conferencing facilities on the adjourned dates.
(iii) The Civil Judge, Senior Division at Thane shall endevour to dispose off the Hindu Marriage Petition No.417 of 2016 within a period of six months from the date of this Order.
(iv) The parties shall not seek adjournment/s unless absolutely necessary.
(v) The Civil Judge, Senior Division at Thane shall also not grant adjournment/s to either side unless absolutely necessary. (vi) All contentions of the parties are kept open. (v) The Respondent undertakes to pay the monthly maintenance to the Applicant as directed by this Court on the due dates. The undertaking is accepted. 3.
The above Miscellaneous Civil Application No.233 of 2016 is accordingly disposed off.
