By an order dated 03.08.2017, the Applicant was granted interim relief. It is the prosecution case in nutshell that the Applicant along with other three accused persons assaulted first informant with fist blows and with the aid of a metal fighter. The role of assault with the aid of metal fighter is attributed to coaccused Farman Jafari. The role attributed to the Applicant is that he assaulted the first informant and other witness with fist blows. The record indicates that the other accused persons are arrested by the police and are now released on bail.

After taking into consideration, the role attributed to the Applicant in the present crime, this Court is of the view that the custodial interrogation of the Applicant for further investigation of the present crime is not necessary. In view Sneha Chavan 1/2
