The learned APP has tendered on record a copy of order dated 3 October 2019 passed by this Court in Criminal Bail Application No. 2272 of 2019. The said order reads thus: "1.

After arguing for some time, when the Court was not inclined to enlarge the applicant on bail, learned counsel for the applicant seeks leave to withdraw this application.

Accordingly, the application is dismissed as withdrawn".

The learned counsel for the applicant has not disputed that the aforesaid application was fled by the present applicant. The only submission is that there is no progress in the trial and therefore, the present application be considered on merits as the applicant is in jail for more than 4 years.

Considering the facts and circumstances, the trial Court shall endeavour to dispose of the trial, as early as possible and in any case within a period of one year from the date of receipt of copy of this order. If the trial is not concluded within one year, the applicant is at liberty to move an application for bail before the trial Court.
