DATE: 20 NOVEMBER 2015 P.C. :- 1] By order dated 18 November 2014, Rule was issued in this petition and the same was made returnable after twelve weeks. Interim relief in the following terms was also granted: "During the pendency of this petition, impugned order is stayed. However, respondent is allowed to have access to the child Sagar for a period of two hours between 11 a.m. to 1 p.m. on every Sunday at the Petitioner's house situated at R. No. 13, Sector No. 20, Plot No. 24, Siddhi Anand Park, Chikali Pradhikaran, Chinchwad, Pune 411019." 2] Despite service, the Respondent has chosen not to appear in this matter. Accordingly, it would be appropriate to modify the impugned order in terms of the aforesaid interim order made in the present petition. The same is directed accordingly. The interim order made by this Court shall operate during the pendency of the 1/2

skc 226-WP-7984-14 Marriage Petition No. 885 of 2013 pending before the 5th Joint Civil Judge, Senior Division, Pune.

3] The Civil Judge is however directed to dispose of the Marriage Petition No. 885 of 2013 as expeditiously as possible and in any case within a period of one year from today. The Petitioner is directed to place on record the authenticated copy of this order. 4] Rule is made absolute to the aforesaid extent. There shall be no order as to costs.
