This Appeal is filed by the Appellant challenging the Judgment and Award dated 02/04/2007 passed by the learned Additional Member. M.A.C.T., Pune, in Claim Application No.466 of 2003. There were URS 1 of 2

2 26-FA 2509-07.odt originally 5 Respondents. The Appellant - Insurance Company - is the insurer of the vehicle of the Respondent No.5. The Respondent Nos.1, 2 and 3 are present before the Court. They are represented by learned Counsel Mr. C. M. Lokesh. The Respondent No.4 has expired on 09/07/2013. The death certificate in that behalf is produced before us. A copy of the death certificate is taken on record and marked 'X' for identification.

Today, the parties have tendered Consent Terms before us. They have signed the Consent Terms. Ms. Dnyanada Pawar is present before the Court. She is the Administrative Officer working with the Appellant. She has also signed the Consent Terms. We have perused the Consent Terms. The Consent Terms are taken on record and marked X-1 for identification. First Appeal No.2509 of 2007 is disposed of in terms of these Consent Terms.

The Appellant shall be entitled to refund of statutory fees and Court-fees as per the rules.
