Rule. Ms. Bane waives service on behalf of the respondents. At the request and by consent of the parties, Rule is made returnable forthwith and Petition is taken up for final hearing. 3.

Mr Haridas states that aggrieved by the order dated 31.1.2015, the petitioner has instituted Appeal before Hon'ble Minister for State, Co-operative Department, Mantralaya, Mumbai. Ms. Bane, upon taking instructions, states that the first date of hearing is 2.9.2015 and the Hon'ble Minister will decide the Appeal within two months from the date of appearance of the parties. Mr. Haridas assures that the petitioner will attend the Hon'ble Minister for State, Cooperative Department, on 2.9.2015 and extend the fullest cooperation for disposal of the Appeal.

In view thereof, the petition is disposed of in the following terms.

(i) The petitioner shall appear before the Hon'ble Minister for State, Co-operative Department, on 2.9.2015.

(ii) Honourable Minister for State, Cooperative Department, is requested to decide the Appeal within two months from the date of appearance of the parties.

(iii) During the pendency of the Appeal, the impugned order shall remained stayed. It is made clear that by granting stay to the impugned order, this Court has not expressed any opinion on merits of the case on either way. All the contentions of the parties on merits are expressly kept open.

(iv) In case, adverse order is passed by the Appellate Authority, same shall not be given effect for a further period of two weeks from the date of service of the same upon the petitioner. (v) Rule is made absolute in the above terms, with no order as to costs. Parties to act on the authenticated copy of this order. (R.G.KETKAR, J.)
