Heard learned Counsel for the Applicant and learned APP for the State.

The learned APP has produced on record Orders dated 23rd November 2016 and 4th April 2017 passed by this Court in the case of co-accused Chagan Abbas Late and Pravin Rajendra Nagargoje respectively. In view of the observations made by this Court in the said Orders, the learned Counsel for the Applicant on instructions seeks leave to withdraw the present Application with liberty to file afresh Application for bail before the Trial Court, if the trial arising out of C.R. No.86/2016 registered with Vairag Police Station, Solapur and now culminated in Sessions Case No.41/2016 does not commence within a period of one year from today. Leave and liberty granted. 3.
