Learned counsel for both the parties submit that the parties have settled the matter and they are present in the Court. Learned counsel for both the sides further submit that parties have filed the Consent Terms. Their identities are verified by the Court Sheristedar. The Consent Terms are filed between the appellant and respondent no.1. The said Consent Terms have signed by the appellant and respondent no.1 and their respective counsel. The Consent Terms dated 25.09.2017 are taken on record alongwith the annexures A,B and C and and marked as Exhibits-A, 1A,1B and 1C.

Learned counsel for the appellant submits that he has no claim against respondent no.2 because he is formal party and he is claiming through respondent no.1. An undertakings given by both the parties in clause nos. 8,14, 18,21 and 22 of the Consent Terms are accepted. Parties agreed that the order of status quo passed by this Court shall continue as provided in clause No. 15 of the said Consent Terms. 3.

The order of status quo to continue till the events/things mentioned in clause No. 15 of the said Consent Terms to take place. The original Suit No. 1564 of 2016 pending before the City Civil Court, Bombay is also to be decreed and to be disposed of in view of the said Consent Terms.

Appeal from Order is disposed of in view of the Consent Terms. 5.

In view of the disposal of the Appeal, Civil Application also stands disposed of.
