The above Writ Petition has been filed for seeking direction that the Central Government Industrial Tribunal - cum- Labour Court No.2, Mumbai, be directed to decide the Application No.LC-2/2 of 2014, as the said Tribunal has already heard the said application. It seems that though application was heard by CGIT-2, Mumbai, final orders have not been passed in view of the Notification dated 14-1-2000 which carves out the Jurisdiction of the CGITs in respect of the matters arising under the Industrial Disputes Act, 1947. As per the said Notification, the division of work mentioned therein the application under Section 33 C(2) of the Industrial Disputes Act, against the Respondent No.3 herein would lie before the CGIT-1, Mumbai and it is probably for the said reason that the CGIT-2 had stayed its hands in so far as mmj

In view of the fact that the CGIT-2 has already heard the Application No.LC2/2 of 2014 filed by the Petitioner which fact is not disputed by the Learned Counsel appearing for the Respondent No.3. Hence notwithstanding the Notification dated 14-1-2000, we direct the CGIT-2 Mumbai to pass final orders in the said application latest by 30-11-2018.
