Heard learned Counsel for the parties.

This application is for restoration of First Appeal no. 203 of 2006, which was dismissed in view of conditional order dated 27.04.2006 for non filing of private paper book.

The learned counsel for the applicant submits that the private paper book is ready. He undertakes to file the same within two weeks from today. Statement is accepted.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

a) First Appeal no. 203 of 2006 is restored on file.

b) Time is extended to file private paper book as per order dated 27.04.2006 by two weeks from today, failing which the Civil Application shall stand dismissed without further reference to the court.

c) If private paper book is filed within stipulated time as stated herein above, applicant to serve the copy of private paper book on respondent's advocate immediately thereafter.

d) Civil Application is disposed of accordingly.
