This is an Application filed under Section 438 of the Code of Criminal Procedure, 1973 by the aforesaid Applicant apprehending his arrest in Crime No. I-84 of 2019 registered with the Badlapur(E) Police Station for the offences punishable under Sections 328, 272, 273 of the Indian Penal Code, Sections 26(2) (i) and 27(B) read with 3(1)(z)(a) of the Food Safety And Standards (Prohibition and Restriction of Sales) regulations, 2011 and Sections 26(@)(iv) r/w. 30(2)(a) r/w. Rule 2, 3 and 4 of the
Notification issued by the State of Maharashtra. 2.
The case of the prosecution is that an information was received that the Applicant was in possession of Gutkha and Pan Masala which was kept in the tempo bearing No. MH-05/DK/2238. In view of the same, a raid was effected, lock of the tempo was broken and prohibited material to the tune of Rs. 9,26,000/- was seized.

By order dated 19.07.2019, this Court ( Revati Mohite Dere, J. ) had granted interim protection to the Applicant with direction to report to the investigating officer on the dates specified in the order.. Learned APP states that the Applicant has complied with the said condition. She further states that investigation has been completed and the presence of the Applicant is not required for the purpose of custodial interrogation.

In the light of the said statement made by the learned APP, the Application is allowed on the following terms and
conditions :- O R D E R (i) In the event of arrest of the Applicant in C. R. No. I-84 of 2019 registered with the Badlapur(E) Police Station, he be enlarged on bail on furnishing P. R. Bond in the sum of Rs. 50,000/- with one or two sureties in the like amount; (ii) The Applicant shall furnish his current address and mobile contact numbers and / or change of residence or mobile details, if any, to the investigating officer; (iii) The Applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

The Application stands disposed of.
