CORAM :

DR.MANJULA CHELLUR, C.J.

AND M.S.SONAK, J.

DATE :

18th November 2016.

P.C. :

Though the learned counsel for the petitioner submits that Water Project to cater the needs of 8,000 population of the village- Shere is not completed in time and, therefore, the present public interest litigation is presented, on going through the averments in the petition, especially the reliefs sought in the petition, we note that the aim of the petitioner is towards the contractor who has taken up the Water Project by a tender and not with regard to non-completion of project in time. However, since the public money is being used for implementing the Water Project in question,

skn 2/2 22560.16-pilst.sxw we are of the opinion, as the funds are already sanctioned to Zilla Parishad, Satara, the Chief Executive Officer, Zilla Parishad, Satara to inquire into the matter since further allegation is made against respondent No.5 who seems to have favoured the contractor while allotting the tender of Water Project as contended by the petitioner. 2.

We direct the Chief Executive Officer, Zilla Parishad, Satara to treat this petition as representation of the petitioner and make a discrete inquiry into the allegations made and submit a report to this Court. The entire exercise shall be done within a period of four months from today.

3.

It is needless to state that since the water is one of the basic necessities, The Chief Executive Officer shall make endeavour to see that the Water Project is completed within a time frame. 4.

With the aforesaid observation and direction, this petition is disposed of.
