Mr. Bubna, the learned counsel for the petitioners states that the petitioners would file an application seeking a reference of the dispute in regard to the payment of compensation under section 35 of the M.I.D.C. Act to the State Government and the State Government should be directed to refer the matter to the Civil Court. The learned counsel seeks permission to withdraw the Writ Petition in this background. The petitioners are permitted to withdraw the Writ Petition.

14.WP8134_2014.doc The Writ Petition is disposed of as withdrawn. However, if the petitioners file an application under section 35 of the M.I.D.C. Act, the concerned officer of the State should take a decision for making the reference of the same to the Civil Court as early as possible and positively within a period of four weeks.
