This is an application received through jail, for modification of condition imposed upon the applicant while releasing him on bail. Heard learned APP and perused the record.

Heard learned APP and perused the record. By an order dated 17.06.2014 this Court had granted bail to the applicant on the condition that he shall furnish PR bond of Rs.50,000/- with one or two sureties in the like amount. As the applicant was unable to comply with the said condition, he preferred Application No. 719 of 2015 which was allowed by an order dated 26.02.2016 by reducing bail amount from Rs.50,000/- to Rs.25,000/- with one or more sureties in the like amount. The applicant has preferred the present application for further modification of the condition praying that he may be released on PR bond only. 2.

The learned APP opposed the application and submitted that 1/2

(17) APPP 656-16 the applicant is an accused in a case under the MCOC Act. The trial pertaining to the said crime has already commenced and the prosecution till date has examined 21 witnesses.

In view thereof, this Court is of the view that the condition imposed upon the applicant need not further be modified. The application is, accordingly, rejected.

The registry to communicate this order to the applicant who is lodged in Mumbai Central prison.
