The petition is filed for transfer of investigation in respect of FIR No.116 OF 2012 registered with Kherwadi Police Station. Mr. Yagnik, learned APP, submits that after completion of the investigation into the said FIR, "B" summary report is already filed before the Metropolitan Magistrate, 32nd Court at Bandra, Mumbai. He has placed on record the report dated 10th February, 2017, of the Senior Police Inspector, Kherwadi Police Station, Mumbai, to that effect. 2.

In the above circumstances, we are not inclined to entertain the petition inasmuch as the petitioner is always at liberty to contest the "B" summary report before the concerned magistrate. Shubhada S Kadam 1/2

8 wp 3310.15.doc Needless to mention that the Metropolitan Magistrate, 32nd Court at Bandra, Mumbai shall dispose of the said "B" summary report only after hearing the petitioner.
