This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 110 of 2021 registered at Faraskhana Police Station, Pune for the offences punishable under Sections 370, 370-A(2) r/w. 34 of Indian Penal Code, Sections 3, 4, 5, 6, 7 of the Immoral Traffic Prevention Act and Sections 4, 6, 17 of the Prevention of Children from Sexual Offences Act, 2012. 3.

I have heard the learned Counsel for the applicant, the learned APP for the State and the learned Counsel for Respondent No.2. Kanchan P Dhuri 1 / 2

On 24 June 2021, a raid was conducted at the house bearing No.1048 and 1049, near Kranti Hotel, Budhwar Peth and the present applicant and other co-accused were found to be running brothel there. According to the prosecution, one of the victims was minor. 5.

I have perused the statement of the minor victim recorded under Section 164 of Cr.P.C. She has not attributed any overt act to the present applicant. According to her, it was co-accused who brought her to brothel and compelling her to indulge in prostitution activity. Apart from it, the applicant is in jail for more than two years. 6.

Considering the above facts and circumstances, I am inclined to release the applicant on bail. Hence, the following order is passed : (i) Application is allowed.

(ii) The applicant - Radhika Narshima Reddy be released on bail in Crime No. 110 of 2021 registered at Faraskhana Police Station, Pune for the offences punishable under Sections 370, 370-A(2) r/w. 34 of Indian Penal Code, Sections 3, 4, 5, 6, 7 of the Immoral Traffic Prevention Act and Sections 4, 6, 17 of the Prevention of Children from Sexual Offences Act, 2012, on furnishing P.R. Bond in the sum of Rs.50,000/- with one or two sureties in the like amount.
