By this Application, Applicant prays for relaxation of Condition No.(ii) of the Order dated 02.05.2022 passed by this Court (Coram: Smt. Anuja Prabhudessai, J.).

Learned Counsel for Applicant submitted that this Court while granting bail order has directed Applicant to deposit amount of Rs.5,00,000/- within two weeks from the date of release on bail, second installment of Rs.5,00,000/- within a month thereafter and remaining shall be deposited in ten equal installments of Rs.96,00,000/- per month.

Learned Counsel further submitted that Applicant has deposited Rs.10,00,000/-. However, it is finding difficult for the Applicant to deposit Rs.96,00,000/- in ten installments. Applicant is ready to deposit the said amount in twenty installments instead of ten installments. Applicant has filed Affidavit in that regard. Hence, requested to allow the Application.

Learned APP strongly objected for relaxation of Condition No. (ii) of the order dated 02.05.2022 on the ground that after depositing Rs.10,00,000/- no amount is deposited by the Applicant, no circulation was taken for depositing the amount. Hence, requested to reject the Application.

Considering the submissions of both the learned Counsel, I pass following Order:-

ORDER

(i) Application is allowed.

(ii) Condition No.(ii) of Order dated 02.05.2022 is modified as under:- "Applicant shall deposit Rs.96,00,000/- per month in 15 equal installments."
