Mr. Dewani learned counsel for the petitioner seeks leave to withdraw the Writ Petition with liberty to challenge the order dated 23.03.2017 passed by the Metropolitan Magistrate, 64th Court, Esplanade, Mumbai, by which the Magistrate has approved the 'A summary Report' filed by the Azad Maidan Police Station, Mumbai in CR No. 124/2015. Leave with liberty as prayed for is granted. Writ Petition is disposed off. Needless to say that we have not gone into the merits of the matter hence, all rights and contentions of the parties are kept open. It is also made clear that petitioner is always at liberty to take benefit of Section 14 of the Indian Limitation Act for the purpose of condonation of delay that Umesh Malani
