The applicant is seeking pre-arrest bail in Crime No.164 of 2016 for the offences punishable under sections 307, 323, 504, 506(2) r/w. 34 of the I.P.C. for an alleged incident dated 21.04.2016. The other similarly placed accused viz; Abdul Hamid Abdul Kuddus Shaikh is already ordered to be released in A.B.A. No.1015 of 2016 vide order dated 11.08.2016 in same crime.

The applicant though is named in the F.I.R. the only role attributed is he has assaulted the complainant with fist blows. The main accused in the crime in question viz; Imran and Ashfaf were already arrested and the weapons sword used in the commission of crime is already recovered.

909.ABA.1411.16.doc In view thereof, in the event of arrest, the applicant be released on bail on executing P.R. Bond of Rs.25,000/- with one or two sureties in the like amount. The applicant shall attend Investigating Officer as and when called. The applicant shall not tamper with the evidence or influence the witnesses.
