Heard learned counsel for the applicant and learned APP for the State.

This is an application for bail in respect of the offence punishable under Sections 363, 366 read with 34 of the Indian Penal Code registered vide C.R. No.167 of 2022 with Bhigwan Police Station, District Pune. The First Information Report is dated 30/06/2022. The applicant was arrested on 28/02/2023.

The complainant lodged the complaint on 30/06/2022. The accused No.1 had eloped with the victim who is the daughter of the complainant's brother-in-law. The applicant 1/3

is accused No.2, the mother of the accused No.1. It is alleged that despite informing the applicant that accused No.1 has eloped with the victim, the applicant gave no response and instead said to the complainant that he may do what he feels like.

The applicant has been in custody since 28/02/2023. The investigation is complete and the charge-sheet is filed. The applicant is a woman. There are no criminal antecedents. In the facts and circumstances of the present case, the applicant can be enlarged as she does not appear to be a flight risk. Hence, the following order :-

O R D E R

(a) The application is allowed.

(b) The applicant- Laxmi Narayan Bichakule in connection with C.R. No. 167 of 2022 registered with Bhigwan Police Station shall be released on bail on her furnishing P.R. Bond of Rs.15,000/- with one or more sureties in the like amount.

(c) The applicant is permitted to furnish provisional cash bail security in the sum of Rs.15,000/-, for a period of eight weeks, in lieu of surety.

(d) For the period of 3 months from today, the applicant shall attend the Investigating Officer of Bhigwan police station once in a month every first Monday of the month between 11.00 a.m. and 1.00 p.m.

(e) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer. The applicant shall not tamper with evidence.

(f) On being released on bail, the applicant shall furnish her contact number and residential address to the Investigating Officer and shall keep him updated, in case there is any change.

(g) The applicant shall attend the trial regularly. 5.

The application is disposed of.
