Learned counsel for the petitioner on instructions of the petitioner submits that the petition has become infructuous, in as much as, the prosecution has withdrawn the case, as against the petitioner and that pursuant thereto, the learned Additional Chief Judicial Magistrate, Nashik vide order dated 21st October, 2022, has disposed of the case bearing SCC No. 347 of 2022 as withdrawn.
