DATED : 30th SEPTEMBER, 2022 P.C:- On appreciating the material compiled in the chargesheet, particularly, the statement when there is an eye witness to the incident, when I expressed my disinclination to entertain the application, learned counsel seek permission to withdraw the same.

The applicant is however, perfectly justified in submitting that he is incarcerated since 18/2/2016 and the trial has not yet concluded.

The learned APP states that five witnesses are already examined and the prosecution intend to examine approximately 10 witnesses.

2/2 915 BA 3853-21.doc Considering that the applicant is incarcerated since 2013, I deem it appropriate to issue directions to the Sessions Court at Dindoshi who is seized of Sessions Case No.259/2016 to conclude the trial within a period of six months from today. The learned Judge shall endeavour to fix the trial on day-to-day basis and conclude the same.

Liberty is reserved in the applicant to move this Court in case the said direction is not complied with. ( SMT. BHARATI DANGRE, J.) Tilak
