The learned counsel for the applicant submits that during the pendency of this application, the C.A. Report is received upon which he wishes to place reliance. It would be a change in the circumstances. Hence, he seeks liberty to withdraw the application with further liberty to approach the Sessions Court under Section 439 of Cr.P.C.

The learned Sessions Judge shall not be influenced by the withdrawal of this application and decide the application on its own merits. Application stands dismissed as withdrawn.
